Liability Waiver & Release

You acknowledge and understand that using the Salvaje Universe application and attending live events, purchasing tickets, participating in live streams, interacting with other users, and engaging in all features of the Service (collectively, the "Activities") involve inherent and significant risks, including but not limited to:

• Physical risks: Personal injury, illness, disability, or death resulting from attending live events, exposure to loud music (hearing damage), crowd-related injuries, exposure to infectious diseases (including but not limited to COVID-19 and its variants), slips, falls, accidents, and the actions of other attendees.
• Property risks: Loss, theft, or damage to personal property including phones, wallets, vehicles, and other belongings at or en route to events.
• Social risks: Harm, harassment, stalking, or other misconduct by other users encountered through the Service, whether online or in person.
• Financial risks: Loss of subscription fees, ticket costs, donations, or merchandise payments due to event cancellations, service disruptions, or disputes.
• Data risks: Exposure of personal information, photos, videos, or location data shared through the Service; unauthorized access to account information; and the potential for User Content to be recorded, copied, or misused by others.
• Psychological risks: Emotional distress, anxiety, or other psychological effects resulting from exposure to content, interactions with other users, or experiences at events.
• Travel risks: Risks associated with traveling to and from live events, including traffic accidents, vehicular incidents, and navigation hazards.

You acknowledge that the list above is not exhaustive and that there are additional risks, both known and unknown, that may result in injury, death, property damage, or other loss.

BY USING THE SERVICE, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH THE ACTIVITIES, BOTH KNOWN AND UNKNOWN, AND ACCEPT FULL RESPONSIBILITY FOR ANY DAMAGES, LOSSES, OR INJURIES — WHETHER TO YOURSELF, YOUR PROPERTY, OR THIRD PARTIES — THAT MAY RESULT. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE AND EXCLUSIVE RISK.

If you attend any live event, you further acknowledge that you are responsible for assessing the safety of the venue, the event, and your own physical and mental fitness to participate. You are responsible for bringing and using any necessary personal protective equipment, including hearing protection.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SALVAJE UNIVERSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, VOLUNTEERS, LICENSORS, AFFILIATES, SERVICE PROVIDERS, EVENT ORGANIZERS, VENUE OPERATORS, AND THEIR RESPECTIVE HEIRS, EXECUTORS, ADMINISTRATORS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION OF EVERY NATURE AND KIND WHATSOEVER, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH:

• Your use of the Service or any feature thereof.
• Your attendance at or travel to/from any live event or venue.
• Your interactions, communications, or meetings with other users of the Service.
• Your posting, sharing, or streaming of User Content.
• Your purchase of subscriptions, tickets, donations, or merchandise.
• The conduct or content of other users, including but not limited to harassment, fraud, or misrepresentation.
• Any error, omission, interruption, deletion, defect, delay in operation, or transmission of the Service.
• Any unauthorized access to or alteration of your data or account.
• Any event cancellation, postponement, or modification.
• Any act of God, natural disaster, or force majeure event.

THIS RELEASE INCLUDES CLAIMS BASED ON THE NEGLIGENCE OF THE RELEASED PARTIES (BUT NOT THEIR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, TO THE EXTENT SUCH EXCEPTION IS REQUIRED BY APPLICABLE LAW), AND INCLUDES CLAIMS FOR PERSONAL INJURY, WRONGFUL DEATH, EMOTIONAL DISTRESS, PROPERTY DAMAGE, FINANCIAL LOSS, INFRINGEMENT OF PRIVACY OR PUBLICITY RIGHTS, AND ANY OTHER INJURY OR DAMAGE OF ANY KIND.

You acknowledge that there may be claims, losses, or damages that you do not currently know about or suspect. You expressly waive all rights under any statute or common law principle that limits the release of unknown claims, including but not limited to California Civil Code Section 1542, which provides:

"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

You knowingly and voluntarily waive the protections of this and any similar statute in all jurisdictions.

In the event of injury or illness at a live event, you authorize Salvaje Universe, event staff, or emergency personnel to arrange for medical treatment as they deem necessary. You agree to bear all costs of any medical treatment provided to you and release the Released Parties from any liability related to such medical treatment, including the failure to provide or arrange treatment, delays in treatment, or the quality of treatment provided.

The Service is not a medical device and is not intended for emergency use. If you experience a medical or psychiatric emergency, do not rely on the Service — contact your local emergency services immediately.

For events designated as 21+, you acknowledge and agree that:

• You are at least 21 years of age and will provide valid government-issued photo ID upon request.
• Alcohol may be present at the venue, and you assume all risks associated with being in an environment where alcohol is served.
• You are solely responsible for your alcohol consumption and your behavior while under the influence.
• You will not drink and drive and will arrange for safe transportation from the venue.
• The Released Parties are not responsible for your actions while intoxicated or for the actions of other intoxicated attendees.
• The venue reserves the right to refuse service of alcohol and entry to anyone, at their sole discretion.
• Providing false identification is illegal and may result in legal action and permanent ban from the Service.

The Service allows users to post, share, and stream content. Salvaje Universe does not control, monitor, or endorse User Content and is not responsible for its accuracy, safety, or legality. You acknowledge that User Content may be inaccurate, offensive, inappropriate, or harmful, and you use the Service at your own risk. The Released Parties are not liable for any damages resulting from User Content or your reliance on it.

You are solely responsible for any content you post and for any consequences of posting it, including legal liability for copyright infringement, defamation, privacy violations, or other claims by third parties.

The Service integrates with and links to third-party services (including but not limited to Shopify, Google, Instagram, Facebook, and payment processors). The Released Parties are not responsible for the actions, policies, or failures of these third parties. Your interactions with third-party services are solely between you and the third party.

You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your attendance at events, your User Content, your violation of this Waiver or any other policy, your violation of any law, or your infringement of any third-party rights.

You are responsible for obtaining and maintaining your own health, life, disability, and property insurance. The Released Parties do not provide any insurance coverage for you. You should check with your insurance provider regarding coverage for live event attendance.

This Liability Waiver and Release shall be binding upon you, your heirs, executors, administrators, successors, and assigns. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

By creating an account, logging in, using the Service, or attending any event, you acknowledge that you have read, understood, and voluntarily agreed to this Liability Waiver and Release. Your electronic acceptance has the same legal force and effect as a handwritten signature. You acknowledge that you have had the opportunity to review this document with an attorney of your choosing.

This Liability Waiver and Release remains in effect for as long as you use the Service and indefinitely thereafter with respect to Activities that occurred during your use of the Service. It applies to all past, present, and future uses of the Service.
