Terms of Use

By downloading, accessing, or using the Salvaje Universe mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, Liability Waiver, and Community Guidelines, all of which are incorporated herein by reference. If you do not agree to these Terms, do not use the Service.

Your use of the Service constitutes your electronic signature and affirmative agreement to these Terms and all incorporated documents.

You must be at least 13 years old (or the minimum age required for digital consent in your jurisdiction) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Certain features, such as attending 21+ live shows, require you to be at least 21 years of age and to provide valid government-issued identification.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account, whether or not you authorized them. You agree to notify us immediately of any unauthorized use of your account. You may register using email or third-party OAuth providers (Google, Apple).

You may delete your account at any time through the app's profile settings. Upon deletion, your personal data will be removed from our active systems, though some data may be retained for legal, accounting, or security purposes.

You are solely responsible for any content you post, upload, transmit, or share on the Service, including clips, photos, videos, audio recordings, comments, messages, live streams, and profile information ("User Content"). By posting User Content, you represent and warrant that:

• You own or have obtained all necessary rights, licenses, and permissions to post and distribute the User Content.
• The User Content does not infringe on the intellectual property, privacy, publicity, or other rights of any third party.
• The User Content is accurate, not misleading, and complies with all applicable laws.

By posting User Content, you grant Salvaje Universe a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, use, display, reproduce, modify, adapt, publish, translate, distribute, and otherwise exploit your User Content within the Service for the purpose of operating, maintaining, and improving the Service. This license survives even after you delete your account, to the extent content has been incorporated into the Service or shared by other users.

You agree not to post User Content that:

• Infringes on the intellectual property, privacy, publicity, or other rights of any person or entity.
• Is defamatory, obscene, pornographic, indecent, abusive, offensive, harassing, hateful, or discriminatory.
• Promotes or depicts violence, self-harm, suicide, eating disorders, or illegal activities.
• Contains malware, viruses, or any code designed to harm or intercept data.
• Impersonates another person or entity, or falsely implies endorsement or affiliation.
• Constitutes unsolicited advertising, spam, or promotional material not permitted by the Service.
• Collects or harvests personal data of other users without consent.
• Discloses sensitive personal information of third parties without their consent.

We reserve the right to remove any User Content that violates these Terms, the Community Guidelines, or that we determine is otherwise objectionable, and to suspend or terminate accounts of repeat violators without notice.

All music, videos, artwork, branding, software, code, designs, and other content provided through the Service that is not User Content (the "Salvaje Universe Content") is the exclusive property of Salvaje Universe or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit the Salvaje Universe Content without our express written permission, except for personal, non-commercial use as explicitly permitted by the Service.

"Salvaje Universe" and all related names, logos, and marks are trademarks of Salvaje Universe. No right or license is granted to use any such marks without our prior written permission.

The Service offers a premium membership subscription ("Salvaje Premium") billed monthly at $4.99/month. Subscriptions are processed through Base44 Payments. Your subscription auto-renews each month unless you cancel before the renewal date. You can cancel at any time through the Manage Plan page — cancellation turns off auto-renewal and you retain access until the end of your current billing cycle.

All subscription fees are non-refundable except where required by applicable law. We may change the subscription price at any time upon reasonable notice. If you do not agree to the new price, you may cancel before the renewal date to avoid being charged the new rate.

You may purchase tickets to live shows and events through the Service. Ticket sales are final and non-refundable. If you are unable to attend a show, you may switch your tickets for a credit toward a future show through the app's ticket switching feature, subject to availability.

For 21+ events, a valid government-issued photo ID matching the attendee name is required for entry. The venue reserves the right to refuse entry to anyone who cannot provide valid identification, is visibly intoxicated, or poses a safety risk. No refund will be provided if entry is refused for these reasons.

Salvaje Universe is not the venue operator and is not responsible for venue policies, capacity changes, event cancellations by the venue, or circumstances beyond our control. In the event of a cancellation by the organizer, refunds will be issued at the organizer's discretion.

You may make voluntary donations (tips) to support the artist through the Service. Tips are processed securely through Stripe and are non-refundable except where required by applicable law. Tips are voluntary gifts and do not constitute an investment, equity, or any ownership interest in Salvaje Universe or the artist.

9.1 Monthly Recurring Tips

When you enable the "Make it monthly" toggle in the tip widget, you authorize a recurring monthly subscription charged to your payment method on the same date each month through Stripe. By enabling monthly tipping, you agree that:

• Your chosen amount will be automatically charged each month on the same calendar date as your initial subscription until you cancel.
• Subscriptions auto-renew each month. You may cancel at any time through Stripe or by contacting support — cancellation turns off auto-renewal and you will not be charged for subsequent months.
• If a monthly charge fails (e.g., expired card, insufficient funds), Stripe may retry the charge. A failed payment may result in the subscription being marked as past due or canceled.
• Monthly tips are voluntary recurring gifts and do not constitute an investment, equity, or any ownership interest in Salvaje Universe or the artist.
• All recurring payments are non-refundable except where required by applicable law.

Merchandise purchases are fulfilled through our third-party store provider (Shopify). Shipping, returns, exchanges, and refunds for merchandise are subject to the store provider's policies. Salvaje Universe is not responsible for shipping delays, lost or damaged packages, product defects, or fulfillment issues once an order is placed with the store provider. Any disputes regarding merchandise should be directed to the store provider.

The Service includes live streaming features. You are solely responsible for your conduct and the content of your live broadcasts. We may record, monitor, moderate, or terminate live streams at our sole discretion, with or without notice. You acknowledge that live streams may be viewed by others in real-time and that you should not share personal, sensitive, or confidential information during broadcasts. We are not liable for the actions or statements of users during live streams.

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Attempt to circumvent payment, subscription, content access, or security controls.
• Use bots, scrapers, spiders, or automated tools to access, collect data from, or interact with the Service.
• Interfere with, disrupt, or overload the Service, servers, networks, or infrastructure.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application.
• Access or attempt to access non-public areas of the Service or another user's account.
• Introduce or attempt to introduce viruses, malware, or harmful code.
• Use the Service to stalk, harass, bully, or harm any person.
• Sell, rent, lease, or otherwise transfer your account to a third party.
• Use the Service in a manner that could damage, disable, or impair the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SALVAJE UNIVERSE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

No advice or information obtained from or through the Service constitutes professional, medical, legal, financial, or any other type of advice. The Service is not intended for emergency use.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SALVAJE UNIVERSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SALVAJE UNIVERSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SALVAJE UNIVERSE AND ITS AFFILIATES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO SALVAJE UNIVERSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).

YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SALVAJE UNIVERSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AFFILIATES, AND SERVICE PROVIDERS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION OF EVERY NATURE AND KIND WHATSOEVER, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE, YOUR INTERACTIONS WITH OTHER USERS, YOUR ATTENDANCE AT LIVE EVENTS, OR YOUR PURCHASE OF TICKETS, SUBSCRIPTIONS, DONATIONS, OR MERCHANDISE.

This release includes, without limitation, claims for personal injury, wrongful death, emotional distress, property damage, loss of data, infringement of privacy or publicity rights, financial loss, and any other injury or damage of any kind. You further agree that you will not initiate or participate in any class action, consolidated, or representative proceeding against the Released Parties.

IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE THE PROTECTIONS OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

You acknowledge and agree that using the Service and attending live events involves inherent risks, including but not limited to:

• Exposure to loud music and sounds that may cause hearing damage.
• Risks associated with crowds, including physical contact, injury, and the transmission of infectious diseases.
• Risks associated with travel to and from events.
• Risks associated with interacting with strangers and other users met through the Service.
• Risks associated with sharing personal information and User Content publicly.
• Risks associated with live streaming, including the potential for your content to be recorded, shared, or misused by others.
• Risks that the Service may contain inaccurate, offensive, or harmful content posted by other users.

You voluntarily and knowingly assume all such risks, both known and unknown, and accept full responsibility for any damages, losses, or injuries that may result.

You agree to indemnify, defend, and hold harmless Salvaje Universe and its officers, directors, employees, agents, licensors, affiliates, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Service or your violation of these Terms.
• Your User Content or your infringement of any third-party rights.
• Your violation of any applicable law or the rights of any third party.
• Your conduct at live events or your interactions with other users.
• Any claim that your User Content caused damage to a third party.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses. You may not settle any matter without our prior written consent.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Except for claims that may be resolved in small claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with Salvaje Universe (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory) shall be resolved by final and binding arbitration, rather than in court, except that you or we may bring claims in small claims court if they qualify.

Arbitration shall be conducted before a single arbitrator under the commercial arbitration rules of the American Arbitration Association (AAA) or JAMS. The arbitration shall take place in the United States. The arbitrator's award shall be final and binding, and judgment may be entered thereon in any court of competent jurisdiction.

You and Salvaje Universe agree that the arbitrator, and not any court, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability, or formation of these Terms, including but not limited to any claim that all or any part of these Terms is void or voidable.

YOU AND SALVAJE UNIVERSE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND EXPRESSLY WAIVE ANY RIGHT TO BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. CLASS ACTIONS AND CLASS ARBITRATIONS ARE NOT PERMITTED. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING.

If this Class Action Waiver is found to be unenforceable, then the entirety of the arbitration agreement (Section 18) shall be null and void, and the parties agree to resolve disputes in the courts described in Section 20.

These Terms and any dispute not subject to arbitration shall be governed by the laws of the United States and the State in which Salvaje Universe is incorporated, without regard to conflict of law principles. Except for claims that may be resolved in small claims court or through arbitration, you agree to submit to the personal jurisdiction of the state and federal courts located in that state for any disputes not subject to arbitration.

The Service may contain links to or integrate with third-party websites, services, and applications (including Shopify, Google, Instagram, Facebook, and payment processors) that are not owned or controlled by Salvaje Universe. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site or service. You acknowledge and agree that Salvaje Universe is not responsible for any damage or loss caused by your use of any third-party service.

Salvaje Universe shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government actions, labor disputes, power outages, internet failures, or failures of third-party service providers.

We may suspend, restrict, or terminate your account and access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms, the Community Guidelines, or applicable law. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the app's profile settings.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections on intellectual property, disclaimers, limitation of liability, release and waiver, indemnification, arbitration, and governing law.

We may modify these Terms at any time. If we make material changes, we will notify you through the app or by other means. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator, the remaining provisions shall remain in full force and effect, and the parties shall negotiate in good faith to replace the invalid provision with a valid one that achieves the original intent.

These Terms, together with the Privacy Policy, Liability Waiver, Community Guidelines, Copyright Policy, and Cookie Policy, constitute the entire agreement between you and Salvaje Universe regarding the Service and supersede all prior agreements and understandings, whether written or oral.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of Salvaje Universe.
